Terms of Service

These terms are provided as a good-faith description of the arrangement and are not legal advice. Have them reviewed by counsel before relying on them.

These Terms of Service ("Terms") govern your access to and use of the LeasePace property-leasing and CRM platform (the "Service"), operated by LeasePace ("LeasePace", "we", "us"). By creating an account or using the Service you agree to these Terms.

1. Accounts

You must provide accurate information and are responsible for activity under your account and for safeguarding your credentials. You must be authorized to act for the organization ("Workspace") you create or join. The Service is intended for business use by property-leasing professionals, not for consumers searching for housing.

2. Subscriptions, usage charges & billing

Paid plans are billed in advance on a recurring basis (via invoice or through our payment processor, Stripe). Fees are non-refundable except where required by law. We may change pricing on notice; changes apply to the next billing cycle. Failure to pay may result in suspension or termination of access. Free trials convert to paid plans unless cancelled before the trial ends.

Usage charges and prepaid balance. In addition to any subscription fee, some features are billed by usage — text and multimedia messages, phone calls and phone numbers, carrier registration, AI actions, and tenant screening. Usage is drawn from a prepaid balance in your Workspace. Current per-action rates are shown in the app before you use a paid feature and may change on notice. If your balance is exhausted, or you have no valid payment method on file, usage-billed features are paused until you top up; the rest of the Service continues to work. Prepaid balance is applied to usage only and is not redeemable for cash.

3. Acceptable use

You agree not to misuse the Service, including: violating any law (including the Fair Housing Act, the Fair Credit Reporting Act, the TCPA, and applicable SMS/telemarketing rules), sending messages without required consent, infringing others' rights, or attempting to disrupt or gain unauthorized access to the Service. You are responsible for obtaining consent for any contacts you message and for your own A2P 10DLC registration where required.

Recorded calls. Calls placed or received through the Service are recorded and transcribed automatically, on both sides. Some jurisdictions require the consent of every party to a recorded call. You are responsible for giving any notice and obtaining any consent your jurisdiction — and your callers' jurisdictions — require, including any spoken recorded-line announcement. The Service does not play such an announcement automatically.

4. Your content & data

You retain ownership of the data you submit ("Customer Data"). You grant us a limited license to process it solely to provide and secure the Service, as described in our Privacy Policy. You are responsible for the accuracy and legality of Customer Data and for your tenants'/applicants' personal information, including lawful use of screening reports. You are also responsible for having the right to connect any third-party account or document you link to the Service, including any spreadsheet owned by someone else.

5. Third-party services

The Service integrates with third parties (e.g., Twilio for messaging and voice, Weimark for screening, Anthropic for AI features, Google for maps, calendar and linked spreadsheets, Stripe for payments). Your use of those features is also subject to their terms. Messaging and voice run on Twilio accounts LeasePace owns and operates on your behalf; you do not contract with or pay Twilio directly, and the corresponding usage is billed to you by us as described in Section 2.

Where you connect Google, LeasePace's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. Linked spreadsheets are read-only: LeasePace never writes to, edits, or shares your spreadsheet.

6. AI features

The Service includes AI-assisted features (such as an automated lead responder, drafting tools, call and screening summaries, and spreadsheet column mapping). AI output may be inaccurate; you are responsible for reviewing communications sent on your behalf. The AI identifies itself as an AI on first contact and does not impersonate a person. Customer Data is not used to train AI models.

7. Termination & deletion

You may cancel at any time from billing settings. To permanently delete your Workspace and its data, email support@leasepace.io from the Owner's address; we will delete it and confirm. We may suspend or terminate access for breach of these Terms. On deletion, Customer Data is removed as described in our Privacy Policy.

8. Disclaimers & liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, LeasePace is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the fees you paid in the 12 months before the claim. The Service is not legal advice; you are responsible for compliance with housing, privacy, and communications laws.

9. Indemnity

You will defend and indemnify LeasePace against claims arising from your use of the Service in breach of these Terms or applicable law — including claims relating to messages you send, calls you record, screening decisions you make, or data you connect that you did not have the right to connect.

10. Changes

We may update these Terms; material changes will be notified in-app or by email. Continued use after changes take effect constitutes acceptance.

11. Governing law & contact

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws rules, and the state and federal courts located in New Jersey will have exclusive jurisdiction. Questions about these Terms: support@leasepace.io.
